nfant Labs, Inc. (“nfant®,” “we,” “us,” or “our”) cares about your privacy. This Privacy Policy describes the information we collect when you use access https://nfant.com (the “Site”), mobile application (“App”), devices (including the nfant® Thrive), and related products and services (collectively, our “Services”). It also includes how we use, disclose, safeguard, and store that information.

By accessing and using our Services, you agree to the practices described in this Privacy Policy. We encourage you to read this document carefully to understand our approach to safeguarding your privacy and ensuring transparency in our operations.

2. Information We Collect

We collect information to provide and improve our Services, communicate with you, and comply with legal obligations.

a. The information you provide: We collect the information you submit willingly into our Site, App, and devices. This information contains mostly personal information. This may include:

  • Name
  • Email address
  • Mailing and Shipping Address
  • Phone Number.
  • Username, Password, and profile details.
  • Payment method information, such as your card details (we do not store this information).
  • Information you provide about other people, such as when you gift an item.
  • Information about your baby
  • Your organization
  • Motherhood status

We may collect this information when you directly use our forms, including the registration form, contact us form, newsletter form, order submission form, payment form, shipping form, etc.

Please note that you are not obligated to submit any information to us – it is optional. However, we are unable to provide our Services without this information.

b. Information we collect automatically: We use technologies, such as cookies (see our cookie policy below), pixels, and third-party analytical tools to collect analytics when you use our Site and App. The information we collect automatically may include the following:

  • Information related to feeding patterns and metrics collected through our devices.
  • Information related to your use and participation in beta testing, including errors, crash, features used, and the like.
  • Your browsing device properties, including the IP address, geolocation, browser type, and operating system.
  • Details of your transactions, including the product you purchase, time and date, payment method used, and amount.
  • Your interactions with our Site, App, and content, including your search terms, pages viewed, links clicked, features accessed, referring URL, etc.

c. Information shared by third parties: Our third-party service providers may provide us with some of the information described above. For example, our third-party payment processor may share with us information regarding your transaction, such as your name, time and date of transaction, etc. Likewise, third-party analytical tools may provide us with analytics.

3. How We Use Your Information

We use the information we collect for various purposes, including:

  • To allow you access to and use our Services;
  • To analyze behavior from data collected through the App and devices and provide tailored insights and recommendations;
  • To identify performance issues, refine algorithms, and improve product functionality during beta testing;
  • To contact you, provide support services, send administrative messages and newsletters, and respond to your queries, questions, and complaints;
  • To take your orders, process your payments, provide you with updates, and deliver your order;
  • To handle and facilitate returns, refunds, and disputes you may have with us;

a. Disclosure to service providers in connection with our Services. We utilize third parties to help us with some of our Services and may share your information with them for this purpose. This may include for payment processing, website hosting, email management, analytics gathering, website security and fraud detection, product delivery, etc. While third parties may access your information to provide these services for us, they are carefully selected and are under obligation to only use your information for these purposes only. b. c. Disclosure in connection with a Business Transfers. In the event of a business transfer transaction such as a merger, acquisition, or sale of any of our assets, your personal information may be transferred to the relevant third parties as part of the transaction. In such cases, we will ensure that any entity acquiring your information honors the commitments we have made to you under this Privacy Policy.

d. Disclosure with your consent: In any other instances where we may need to share your personal information, we will obtain your consent before doing so. This may include, for example, sharing your details with partners for special promotions, collaborations, or events.

5. Cookie Policy

As mentioned above, we use cookies on the Site and App for specific tasks, including gathering analytics, securing the Site and App, remembering user preferences, enabling necessary functions of the Site, App, and similar devices.

Cookies are tiny pieces of data that are stored on your device when you access a website or app or interact with a content. With respect to the Site and App, cookies are set by nfant® and its third-party service providers. For example, Shopify, Zoho PageSense, and Microsoft Clarity may set cookies on the Site and App to gather analytics on our behalf.

The following types of cookies may be set on the Site and App:

  • Necessary cookies. These cookies are essential for the Site to function properly. They enable core features like security, accessibility, and network management. Without these cookies, the Site cannot operate effectively.
  • Analytics cookies. Analytics cookies help us understand user behavior by collecting information about the Site traffic, visitor demographics, and engagement patterns. These insights allow us to make data-driven decisions to optimize the Site. It also allows us to provide baby feeding analytics on the App and devices.
  • Performance cookies. Performance cookies collect anonymous data on how visitors interact with the Site, such as which pages are accessed most frequently or any errors encountered. This helps us improve the Site performance and user experience.
  • Functional cookies. Functional cookies enable enhanced functionality and personalization by remembering user preferences and settings, such as language choices or login details. These cookies ensure a more seamless browsing experience.

Cookies may be retained on your browser and device depending on the duration type:

  • Session cookie. Are those cookies that are set to expire automatically immediately after you exit the Site

As mentioned, we use third-party analytics tools from providers like Zoho PageSense, Microsoft Clarity, Facebook (Meta), and Gauges. These tools are responsible for tracking users anonymously when they access the Site, use the App, and click some of our content. Analytics tools use cookies and similar technologies to gather analytics (as described in the Cookie Policy section above).

If you do not want to be tracked across the Site, you can prevent that by:

  • Blocking analytics cookies through your browser privacy settings or the cookie consent banner on the Site footer.
  • Downloading cookie blocking browser add-ons and extensions.

7. Email Newsletters

If you subscribe to our email newsletters by ticking the email consent box on the checkout page or the newsletter form on the applicable part of the Site, you are consenting to receiving periodical promotional content, news, updates, and offers from nfant® regarding our products and feeding support.

You can always withdraw your consent to our email newsletters at any time by clicking the “unsubscribe” button in any email we send to your email address.

8. How We Secure Your Information

We secure the Site, App, and devices by technical and organizational measures against loss, destruction, access, modifications, or distribution of your information by unauthorized persons. We utilize updated security measures, trusted third parties,

and security practices to safeguard your information. The transmission of information from your browser to our servers are encrypted, and we store the information on secure servers.

However, while the security of your personal information is important to us, remember that no method of information transmission over the internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security.

In the event of any data breach that affects your information, we will notify you and applicable enforcement agencies in accordance with legal requirements.

9. How Long We Retain Your Information

We will retain any information we collect from you until the purpose for which we collect it is achieved or you exercise your right of deletion (described below). When your information is no longer necessary, we will delete it automatically in accordance with the law and any operational requirements. For example, if you request the deletion of your information, we will delete them from our database but may retain certain information (such as your transactions) to comply with the law, tax requirements, and dispute facilitations.

You have the following rights concerning our use of your information:

  • Right to access. You can request to access the information we collect, use, share, and disclose about you in a machine-readable format. You can also request that we transfer your information to another service provider. You can contact us to exercise this right.

  • additional security for information categorized as sensitive personal information.
  • Right to opt out of certain processing. Where applicable, you may opt out of your data being used in research studies by adjusting your settings on the App or contacting us.
  • Right to non-discrimination. We will not discriminate against you for exercising your privacy rights. We will not deny you our products and Services, charge you a different price, or provide a different level of service if you exercise these rights.

11. Children’s Privacy

Although our Services involve feeding metrics/patterns about infants, we do not directly solicit information from children. We directly obtain this information from their parents or legal guardians. By using our Services and submitting personal information, you warrant that you are at least 18 years of age.

We do not knowingly allow children under 18 to independently access or use our App and devices, and we do not collect personal information directly from them. If we become aware that we have inadvertently collected personal information from a child without parental consent, we will take steps to delete it promptly.

We may collect children’s feeding-related data through the nfant® Thrive Bottle or other devices to enhance product features and provide tailored feeding insights. Such data is anonymized and aggregated for research, product improvement, or regulatory reporting purposes.

12. Do Not Track Signals

Your device browser may offer a “Do Not Track” (DNT) feature that, if activated, allows you to automatically transmit a signal to website owners that you do not want your online activities tracked on their website. At this time, nfant® does not respond to the DNT signals due to its inconsistency among industry participants.

13. Third-Party Links

The Site may contain links, content, and plugins to other websites, apps, or services that are not under nfant®’s control. When you link to another website, app, and service through the Site, read their privacy policies to understand their privacy policies, as this Privacy Policy does not apply to them.

14. Geographic Scope

nfant®’s products and Services are intended for customers in the United States. All data collection, storage, and processing activities occur in the United States, and we do not actively market or sell our products outside of this region. If you access the Site from outside the US, please note that your information will be processed according to US data protection laws, which may differ from those in your country of residence.

15. Changes to This Privacy Policy

We may revise, update, and change portions of this Privacy Policy at any time due to changes to applicable laws or any part of our Services. Such changes shall immediately go into effect upon us making them. And the date of effect will be indicated by the “Last Updated” date at the top of this page.

We reserve the right to notify you of updates and changes to this Privacy Policy via your submitted email address or by displaying a notice on the Site and App. Your continued use of our Services after such changes constitutes your acceptance of the new Privacy Policy.
